Terms and Conditions

1. Definitions

“We”, “us” and “our” refer to Hiflights Ltd.


“You” and “your” refer to all persons named on the booking.


“Booking” refers to the flights(s) you have purchased via Hiflights Ltd.


“Airline” refers to the company who will be providing your flight(s).


2. Terms & Conditions

These Booking Terms & Conditions govern your booking with Hiflights Ltd, a company registered in England and Wales, with the company number 14781289 and registered office 36 Northwick Road, Evesham, Worcestershire, WR11 3AL. They govern our rights and obligations under the contract between you and us.


Please note: We act as an agent of the Airline in relation to all bookings made with us. 


2. Your Contract With Us

When making a booking you will enter into a contract with us. Your booking is subject to these Booking Terms & Conditions which we advise you to read carefully prior to booking. All bookings are subject to availability with the Airline. Upon a successful booking we will email written confirmation to you with the acceptance of your booking.


3. Your Contract With the Airline

Upon receipt of full payment for your booking your ticket will be purchased with the Airline. At this point you will enter into a contract with the Airline. Your contract with the Airline will be subject to their Terms & Conditions which we advise you read carefully prior to making your booking with us. As an agent we accept no responsibility for the acts or omissions of the Supplier/Principal. 


4. Pricing

All pricing is dictated by the Airline. We do not guarantee that any price we advertise will still be available at the time of booking. All pricing displayed on our website are live. Your price will be guaranteed following a successful booking, even if the price should change prior to full payment being made.


5. Booking

When making your booking it is your responsibility to ensure all details accurate and correct. Any changes to these details will be subject to the Airlines relevant charges plus an additional £10.00 amendment fee. Please ensure the names given are the same as in the relevant passport. The booking details provided to us will be passed on only to the relevant Airline, or other persons necessary for the fulfilment of your booking. This may include public authorities such as customs or immigration if required by them, or as required by law. In making your booking you consent to this information being passed on to the relevant persons.


6. Lead Booker

The lead booker on any booking with us accepts the full responsibility of collecting the full balance payable for the booking and indemnifies “Company Name” against any loss from any individual failing to pay within your group. The lead name of the group is also responsible for ensuring that all group members are aware they are bound by our terms and conditions. The lead name is also responsible for the completion of the online guest list on behalf of all persons on the booking. It is understood that those booking via email or telephone agree to, and accept our terms and conditions. 


7. Payments

Flexible payments are available via monthly payments to clear the cost of your booking. Full payment must be received on or before your deadline date. Your deadline date is determined by the Airline. We cannot alter or amend your deadline date in any way. Failure to make full payment on or before your deadline date will result in the cancellation of your booking.


All bookings made with a flexible payment arrangement will be required to pay a non-refunable deposit of £20.00 per person at the time the booking is made.


In some cases the deadline date may be the same as the date you are making your booking. This is determined by the Airline you are booking with. We cannot guarantee the availability of spreading the cost of your booking in these cases. All payment deadlines are subject to the Airlines Terms &

Conditions.


If you cancel your booking (or we do in accordance with clause 7) you will be liable to pay the relevant cancellation charge.

Payments will be taken on the agreed flexible payment date. In the event that a payment cannot be successfully taken we will attempt the payment again the following day.


All payments must be made by Credit/Debit Card.


8. Missed Payments

If we are unable to collect your flexible payment on the agreed date we will contact you in order to make payment. If payment is not made within 2 weeks of the due date we reserve the right to cancel your booking. If this occurs you will be subject to a £20.00 cancellation charge per person on your booking. All money already paid towards (less your cancellation charge[s]) your booking will be refunded to the card details we hold. If this card has expired or is no longer available you should contact our Customer Services Team.


If your booking is cancelled due to a missed payment the price of your booking will also be subject to charge in accordance with clause 8.


9. Cancellation by You

You are able to cancel your booking at any point before your deadline date. A cancelled booking will be subject to a £20.00 cancellation charge per person on your booking. Any payments made towards the cost of your booking will be refunded back to the card we hold, less any cancellation charges. If this card has expired or is no longer available you should contact our Customer Services Team.


If you wish to cancel your booking after your deadline date you will be subject to the Airlines cancellation charges as outlined in their Terms & Conditions. These can vary between Airlines and we recommend you read them carefully before making your booking. In addition to any cancellation charges levied by the Airline, you will also be subject to a £20.00 cancellation charge per person on your booking by us.


10. Cancellations by Us

We will only cancel your booking due to missed payments in accordance with clause 7. If we are forced to cancel your booking you will be subject to a £20.00 cancellation charge per person on your booking. Any payments made towards the cost of your booking will be refunded back to the card we hold, less any cancellation charges. If this card has expired or is no longer available you should contact our Customer Services Team.


The Airline reserves the right to cancel your booking in accordance with their Terms & Conditions. We hold no liability if this occurs. If your booking is cancelled by the Airline a full refund of all payments will be made to the card we hold. If this card has expired or is no longer available you should contact our Customer Services Team.


11. Flights

All details relating to your flight, including, but not limited to, flight times, check-in requirements, luggage and carry-on requirements are subject to the Airlines Terms & Conditions. We hold no liability in the fulfilment of these terms, which are applicable to each person on your booking. Any charges levied by the Airline in accordance with their Terms & Conditions will be payable by you.


12. Financial Protection 

We are committed to consumer financial protection. All bookings made with us are fully insured for monies paid towards your booking. Your money is fully protected and is held within an independent Trust Account, managed by Protected Trust Services Ltd of 307-315 Holdenhurst Rd, Boscombe, Bournemouth BH8 8BX and its Trustees, chartered accountants - Elman Wall Ltd of 8th Floor, Becket House, 36 Old Jewry, London EC2R 8DD.


13. Alterations made by You 

We shall try to accommodate any reasonable changes you wish to make to your booking. Alterations and amendment requests should be made with us and not the Airline your flight has been booked with. All alterations must be made by the Lead Booker and no less than 3 weeks prior to your Deadline Date. 


Any alterations which increase the value of your booking will be paid by you. The amended value will be distributed across your flexible arrangement. If your arrangement has already been completed the amended value will be due immediately. Amendments will also incur an administration charge of £10.00 per person which is due immediately and payable by you.



Any alterations which decrease the value of your booking will amend the instalments of your flexible arrangement to the new value. If your flexible arrangement has already been paid in full, a refund will be issued for the value your booking has decreased by to the card details previously used on your flexible arrangement.


14. Your Obligations 

You shall at all times behave in a safe, responsible and courteous manner; comply with all instructions; regulations and codes of practice issued by us or the Airline(s); ensure that you comply with all arrival times, and dress appropriately for the event. If you breach these obligations we may cancel or curtail the event or any part of it and in those circumstances you shall not be entitled to any refund. You shall take out insurance suitable for your needs (including delays for events involving travel by land, sea, or air) before your flight.


15. Our Obligations 

We shall take reasonable care and skill in arranging your flight and comply with all applicable laws in relation to the flight. All of the photographs and illustrations we use on our website and in literature (including quotations) are for marketing purposes and may not entirely represent the actual products received.

 

17. Contracts (Rights of Third Parties) Act 1999 

No part of this agreement shall confer on any third party any benefit or right to enforce any terms of this agreement. 


19. Jurisdiction 

This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between you and us. 


20. Changes to these Terms and Conditions 

We may need to make changes to these terms and conditions from time to time. Any changes can only be made by us and not any third party member. We reserve the right to amend or improve these terms and conditions without prior notification. When it is necessary for changes to be made, you will be notified and the amended terms will be made available to you. All bookings will abide by the amended terms, with the exception of those already made.
